Things To Remember When Choosing A San Diego Defense Lawyer

by Bella Holly

Whether a person is responsible for a crime they are accused of or not, it is quite possible for them to be entertaining a severe sentence-even prison. In Southern California, San Diego defense lawyers can help to prove the innocence of the accused, or bargain for a lesser punishment if the defendant is found guilty. The help of a lawyer could very well save a person from going to prison.

For starters, not all attorneys practice trial law or criminal law. In fact, most of them don’t. So make sure the attorney you’re dealing with has some experience at handling not only cases that go to trial, but also criminal cases that do so.

After all, he or she is going to be fighting to preserve your liberty (your unbridled freedom to move around, which jail will definitely restrict), so make sure your prospective lawyer is someone who’s done it before in the past.

One thing you should try to avoid, mainly if you are dealing with a criminal offense, is talking to anyone but a lawyer. Friends, family, and police should not hear the details of your case until you have first told it to a lawyer, and only then if the lawyer advises you that publicly talking about the matter is okay. The reason for this is due to the fact that anything you say to a person (a potential witness) can be used against you in court.

In the above circumstance, it’s best to look around, find a good San Diego criminal defense lawyer, and then work with him or her on the things that can be said and the things that are best left between a lawyer and a client. This is not to assume that you’ve done anything wrong at all; it just is a caution that ANYTHING you say can be taken the wrong way and used against you, in extreme cases, by the authorities.

So, if you need a San Diego lawyer, or criminal defense lawyer, make sure that’s what you’re getting, and not somebody who practices tort or contract law and thinks he or she has what it takes to do battle with a prosecutor in a criminal court of law. It’s probably not the best you could do, and it could end up hurting more than helping.

Halloween as a Children’s Festival

by Benedict Fisher

Halloween is widely celebrated by families in North America. People young and old like the idea of dressing up, trick-or-treating, and partying in costumes. But many believe that Halloween is an event for children, most probably because Halloween is a celebration of ghouls, ghosts, goblins, and great family relationships.

H is for Halloween and the Harvest

Before the advent of Hollywood-inspired costumes, Halloween was that time of the year in rural places in America for farmers to open their land to hunters. Halloween was a critical time in the year when hunting season was on, and hikers and vacationers began pouring in to pristine lands in the Northeastern region of the US.

In 19th century folklore, harvest time is very important in the US. The telling of tales and legends began when this time of year arrived.

Trick or treat!

For some time, local folk were frightened of short visits in the night during Halloween due to urban legends. Urban legends included:

- People who placed rusted razors into candied apples

- Poisonous treats given to kids.

It was a good thing when more and more homes opened their doors and gave out treats for children in the late nineties. This was a sign that children could now go out on Halloween night, meaning it was safe to roam around their neighborhoods. For adults, it was also a sign that there was nothing to worry about regarding their children’s safety on Halloween night.

Why do people cling to the vision? Many believe that supporting the trick or treat tradition of Halloween showed the degree of solidarity in a neighborhood. If your kids can be safe from harm at night, under the care of all the adults who are anticipating the arrival of the children, then youre in a good neighborhood with responsible adults.

The Academe and Halloween

One of the most eminent American-cultured powerhouses is the unlikely school. During the time when conservative groups started losing grip on Halloween celebrations, schools started to support gatherings during fall. Such events encompassed:

- Halloween processions

- Halloween festivities

Sadly, in the last few years, Halloween has changed into a commercialized event instead of an opportunity to keep strong relationships and renew solidarity in the neighborhood. Also, it has become less of a chance to spend time with great friends and family.

Big Bag O’ Money!

Aside from just being a conventional time for ghosts and other strange things, many business giants are creating more reasons to smile during the holidays. The term “Children’s festival” is slowly becoming an understatement, as candy factories ensure that people can enjoy the festival all year long.

From simple sweets and treats formed molded from several spooky characters like Count Dracula, Werewolves, fangs and snakes, to other children’s novelties, Halloween has erally turned into a commercialized event.

Research states that all Halloween-inspired goods sold every year sum up to a jaw-dropping $950 million. And since majority of the products sold are just mere trinkets, it’s an amazing number. The bottom line is that Halloween is a good time for young children to learn to be wise buyers when they grow up.

Well, that’s Halloween today - play for children, and work for adults.

Voice Writing & Court Reporting?

by Amy Nutt

Court reporting is a career that involves recording the information, testimony, and proceedings of a court case. Since no video cameras are allowed in a courtroom, the court reporter provides the only official record of the proceedings, making this a very important profession, and often one that is paid quite well.

Methods of Court Reporting

Court reporting is not an easy profession, because court reporters must be able to somehow record the information presented in court quickly and accurately, turning it into written transcripts after the day in court is over. In the past, this required professional court reporters to learn the skill of stenotyping. This involved typing using a special typewriter that used symbols to represent spoken sounds, thus reducing the number of keystrokes required to record the information presented in court. This was effective, but took a tremendous amount of training to perfect. The need for this specialized skill is part of the reason that court reporters are paid so well.

What Is Voice Writing?

While stenotyping is still used today, modern court reporters have another option, and that is voice writing. Voice writing involves taking down the information through the spoken word, rather than the typed word. It has been used for a while in conferences and non-court purposes, but is gaining a following in the world of court reporting as well.

Voice writing involves speaking into a silencer that is connected to a laptop computer. The computer has voice recognition software on it, allowing everything the speaker says to be recorded. The silencer keeps the words from being audible to people in the courtroom. The court reporter can then repeat everything that is said, describe people’s reactions, and speak any other details that need to be recorded, and the laptop will translate that into written words. The reporter can then return to the document after the proceedings are over to clean it up and make a presentable copy to deliver to his client. Some voice writing setups also allow the laptop to copy the words spoken by the people in the courtroom along with the commentary from the court reporter.

Is Voice Writing Better?

Voice writing may be a better solution for courtroom records. It tends to deliver a more accurate transcription of the events, particularly when set up to record the actual words spoken in the courtroom. Since people can speak faster than they can type, even with the aid of a stenotyping machine, court reporters using voice writing can record more of the proceedings and their observations than those using traditional methods. It also produces a clearer transcript, so court reporters spend less time editing their final product. This means they can take on more assignments and increase their profits. It also eliminates the possibility of stress injuries, such as carpal tunnel, which are common with professional stenotypists who use their hands repeatedly to earn a living.

One potential downside to voice writing is the fact that it requires highly specialized equipment. Training court reporters about this new way of recording information can be a challenge for some courtrooms. Seasoned court reporters may feel uncomfortable learning a new technology after years of doing things one way. In spite of these downsides, voice writing looks like a promising option for the future of court reporting as a career.

The Automobile Industry And Environmentalists Must Use Their Sustaining Spirit In The Future

by Mandy Ziegler

Sustaining is a spiritual calling for many of us. Creating partnerships between human beings, the environment, our society and our planet is the essential purpose of the sustaining spirit. It is his lifes work. A spiritual archetype can be thought of as an ideal type. It is an expression of our spiritual voice. It gives you direction and meaning to your life.

Recently President Obama announced new tough federal regulations to cut automobile greenhouse gas emissions from cars and light trucks in order to reduce Americas dependence on foreign oil and raise fuel-efficiency standards to 35.5 miles per gallon by 2016. Amazingly, auto industry officials, environmentalists, union workers and politicians seem to welcome the new change but for different reasons.

After serious disputes for many years over these issues with the government and the auto industry, environmentalists praised the new emissions control and fuel economy standards. On the opposing side, the auto makers feel they now have a single national efficiency standard to follow and a reasonable timeline to meet production schedules. But how can these two distinctive groups who have been historically antagonistic towards each other come together to meet a new complex set of regulations after years of opposition? Can they form an alliance to produce a profitable, new idea of transportation and maintain a clean atmosphere at the same time?

With the stakes so high and the outcome so important for both sides, a new type of relationship must be established. Traditional relationships leaving one group with all the power is not an option. There must be a partnering relationship that inspires creative and practical changes. This partnering quality is that of the sustaining spirit. It is not about team building. In fact, the sustaining spirit searches beneath every economic, political, and social process and calls people to learn the most important part of partnering. Only if the automobile industry and the environmentalists can listen to their sustaining spirit will President Obamas initiative, indeed their own survival, have any hope.

The sustaining spirit establishes partnering by way of three avenues intersecting. The first, intentioning, is creating purpose driven actions. In order for partnering to occur, both sides must have the same intentions. Too often human behavior is unintentional. Cultures often act from the memories of the past rather than towards the possibilities of the future. The auto industry fell apart economically because the framework of their social biography disintegrated, leaving them directionless. The lifelong job created by the innovation of the future disappeared. The auto industry embraced a social biography that no longer worked. A partnering relationship, including intentioning, between the auto industry and the environmentalists must start if we are going to move towards a sustainable and prosperous future.

The second avenue use to establish partnering relationships is parity. When all sides of a relationship realize that each offers something of value to that relationship, parity has been achieved. Both the auto workers and the environmentalists must recognize that both have something of value that is needed to achieve their goals. The sustaining spirit does not call for sameness, but instead calls for equivalency yet individuality.

The third avenue needed is learning itself. Partnering is successful only with a mutual and reciprocal learning environment. Reciprocity between nature, modern technology, Mother Earth, and humanity is essential to the success of partnering. The auto industry and environmentalist must learn from both their own and each others mistakes. This awareness towards learning is essential to the sustaining spirit. Will the auto industry and environmentalists accomplish individual goals while helping the other at the same time? The sustaining spirit says, Yes!

Changes in the automobile industry and in the environmental industry depend upon a thorough analysis of conventional and cultural beliefs. It will be essential to give up certain habits to reach goals. This task cannot be forced. Difficult inner work is necessary. The sustaining archetype is all about partnering. All of us can learn to partner with each other and with our earth, environmental and automobile enthusiasts alike, so that each of us and all of us are sustained. Without that, we are lost.

Imperial Kilns Start In Jingdezhen, China

by David Cheng

Jingdezhen is called the porcelain capital of the world for a reason. For the past fifteen hundred years, the small town in southern China produced most of countrys porcelain, with a large proportion of it being made exclusively for royal families.

The very fact that Jingdezhen once produced porcelain for the imperial family is what made the artisans in this town reach such a high level of skill.

In 1278, Mongol emperor Kublai Khan built the first imperial kiln in Jingdezhen. Jingdezhen then made a type of porcelain that was celebrated for being as white as snow. The Mongols revered the color white.

His successors continued to build their own kilns in the following centuries. And at its peak, there were 58 imperial kilns in total. Orders from the imperial palace came in everyday, and the towns porcelain industry was booming.

Eventually the emperors demanded so much porcelain from Jingdezhen that special administrative teams had to be set up just to manage the porcelain production. These managers had to send only the finest pieces of porcelain to the emperor, and sometimes their life depended on it.

One of their duties was to ensure that no one except the emperor could enjoy the top quality porcelain. So how did do they that? They shipped only the best of the best porcelain wares, smashed the rest, and buried the debris in a guarded area. The techniques of making the special porcelain were also carefully protected. Any potter who stepped out of line would be severely punished.

To make the best of the best, sometimes extra effort had to be made. Emperor Yongle was a great fan of blue and white porcelain, which required a special pigment to be used. However this pigment couldnt be found within China. With the most advanced navigational knowledge in the 14th century world, the emperor sent out his best sailors to Persian Gulf countries to get this rare color pigment.

As time went on, emperors passed on and gave way to new dynasties and rulers in China. But the royal kilns of Jingdezhen were not disbanded until the last dynasty fell.

Green Products Has Located an Incredible Low Cost High Output Solar Design

by Michael Edwards

At Green Products, we have come across a product from Cool Earth: Solar Balloons. Cool Earth was created with the mandate of producing electricity using solar power, specifically solar cells. Solar power is not a new concept, but how the sunlight is collected and concentrated is truly unique.

The cost to install and maintain the current flat-panel solar cell design is prohibiting its large scale adoption. The glass cover is easily damaged by windstorms, hailstorms or vandalism. When this happens, it leaves the solar array exposed to the elements where they can be damaged. The unique balloon design by Cool Earth eliminates many of these shortcomings.

One side of the balloon is made from reflective silver Mylar plastic. The other half is transparent to allow in sunlight. The silver material is parabolic-shaped to concentrate the sunlight on to a single point to achieve maximum light concentration. This is why high performance solar cells are used.

This unique design can concentrate the sunlight so well, it produces 300 to 400 times more power per square inch of solar cells than traditional flat-panel solar systems. By regulating the air pressure inside the balloon, they can focus the concentrated sunlight directly on the photocell. The air regulating system is designed to maintain the proper balloon size as the outside air temperature increases or decreases.

The orb has a simple circular metal frame that is used to hold the Mylar in the proper shape. An arm extends from the ring to the top center of the orb. This holds the solar cells that produce the electricity at the proper focal point. The shape of the balloon and consequently the focal point is altered by adjusting the internal air pressure.

One of the areas under consideration is the need to add more peaking power plants, also known as peaker plants. A peaker plant is operational only when demand for electricity is at the greatest, like during the hot summer months. This green product could be used to eliminate rolling brown outages that we have encountered in the past few years.

Another of the aspects we find most interesting at Green Products is how the balloons are linked together with wire, wood and sheet metal. We are also impressed at the lack of limitations that are imposed when the systems are installed and how they eliminate the destructive heat that destroys most solar cells. Soon this system will be installed and go online. Check it out.

Will You Lose Your Home After Filing Chapter 7 Bankruptcy?

by Alan Alder

A Chapter 7 Bankruptcy is designed to give you a fresh start by discharging your debts. But some property that is not exempt may be sold in order to pay off creditors.

One of the main points to consider in deciding whether to file a Chapter 7 bankruptcy is what property you can keep and what property you may have to give up.

Each state has different exemption rules. In Tennessee a single individual can exempt $5,000 of their homestead (house) while a married couple can exempt $7,500.

Tennessee grants an exemption up to $12,500 for individuals over the age of 62. A $20,000 exemption applies to married couples where one spouse is over 62 and the other under 62. A larger $25,000 exemption applies to married couples where both spouses are over 62.

If a minor child or minor children live in the house then each individual who has custody of that child or children may exempt up to $25,000 of the value of their house. A married couple with a child can therefore exempt up to $50,000.

The amount of equity in your house is important to know when considering Chapter 7. If your exempted amount is more than your equity then there is no chance a Chapter 7 Trustee will seek to sell your house to pay creditors.

In the case where your exemption is less than your equity then you have two choices; pay the difference to the Chapter7 Trustee, or allow the Chapter 7 Trustee to sell your house.

If you are behind on your house payment then Chapter 7 might not be the best option. A Chapter 13 repayment plan would ensure you retain possession of your home.

The Emotional Significance Of Memory Boxes

by Oliver Jackson Carter

We have all known from a young age that death is part of life, yet when someone we know and love sadly dies, we feel bereaved and emotional. Of course we feel bereaved and emotional, if we’ve spent a lot of time with someone over the years that we’ve known them, we should feel saddened by the loss, and we should look for ways to remember them.

Whoever you have lost, be it a friend, mother or father, or heaven forbid a child, you will surely want to remember them as clearly as possible, and a “memory box” is the perfect way to do this.

Memory boxes are most commonly used for a mother when either her child dies, or she has a miscarriage or a stillbirth. The memory box in this case wold most likely be filled with items that reflect how the child would have been or was.

Usually, memory boxes will contain these items, give or take a few depending on the person; moulds of the child’s hands and fingers in clay (or something similar), the child’s inked fingerprints, the birth details of the child along with his/her name, pictures and a lock of hair.

This is not the only situation in which memory boxes are used. It is becoming more and more common for people to make them for themselves when they know that they are on their way out.

If a parent knows that they are on the way towards death, but they still have fairly young children, or if someone simply has many close relatives or friends and wants to be remembered, then a memory box would be a great thing to leave behind.

Items normally included in a memory box are things like photographs of the deceased with the recipients of the memory box, any trademark items, eg. if someone always wore the same watch, that would be included, and also fragrances are a good stimulant for the memory.

Memory boxes will always be personalised with the deceased persons name and possibly pictures on the outside and will be something that the people who knew them can hold on to and cherish until the sad day comes when they make their own.
